Legal Question in Construction Law in Massachusetts

Warranty on labor

Is there a one year warranty form for general contractors to sign, with the option of: keeping existing ''temporary'' systems in place- who is responsible for liability/maintenance? or taking down temporary systems to end liability/maintenance potential?

Re: Warranty on labor

It all depends on what the operable written agreement says. Absent governing contract terms, then the specific facts and circumstances of the issues you raise will inform the answers to the quiestions you ask. There is no hard-and-fast answer to your questions.

The analysis also differs depending on your role and what it is you want to occur. Advice about what to do and how to do it would differ depending on what you want to achieve. Then the analysis would be tailored to that.

Give me a call or send an email if you want to discuss the particulars further. This is the area where I do much of my work.
