A contractor may certainly get paid under those circumstances. The conduct described would also provide the customer with certain defenses and claims against the contractor. What is your real question?

Your question is short on the facts, but I assume the work was performed under an oral agreement as opposed to a written agreement. Generally, you still must pay for the work that was satisfactory completed, but you may have defenses for work that was performed incorrectly. Again, without specific facts it is difficult to analyze.
