I applyed for an american express corporate card for the co. I work for . I was declined on the basis that they say there is a balance from 1986.I never had an american express card although a family member may have had access to my soc#.For the sake of argument say I did have one but never heard from them for 14 years now I hear this.Is there any legal recourse for me?If I claim fraud and it was a family member what happens? How do they investigate fraud from 14 years aggo?

Re: american express

How much was owed? Have you told them you never got a card before? Is their fraud investigation unit investigating? Check with another lawyer to be certain, but probably it's too late for them to bring charges against your family member by now.

What address were they using? Was it yours? Get a copy of the application for the card from them, and do your own investigation.

Can AMEX do this, block you from getting another card from them, based on something that happened 14 years ago? YES. They can no longer report through the credit reporting bureaus that you owe them money, but there's no statute of limitations on their use of the information for themselves and that's a perfectly good use of good information. Walk away and get another card (like Discover) or do some investigating of your own -- don't assume or guess that it was your family member. Get the facts.

Good luck!
