Legal Question in Consumer Law in Massachusetts
My auto loan with CitiFinancial Auto was paid off in full on 08/03/10. On 08/19/10, an online payment that I did originally authorize back in June 2010 was deducted from my checking account on 08/19/10. I assumed that because my loan account was paid off in full, that all recurring, automatic online payments would be cancelled. I also called the CA customer service number on 08/17/10 and spoke to a rep that confirmed he could not locate any payments to be deducted from my checking account.
I have been trying since 08/19/10 to receive a refund and have not had success as of today. I was provided false information by a CA rep that a refund check was to be issued back on 09/09/10. When I followed up on 09/16/10, it was only then that I found out my auto loan account had been sold to Santander Consumer USA. I never received any type of notification regarding this change, is this even legal? Also, I was told today by cs rep "Chantelle" with Santander that CitiFinancial Auto should have issue a refund check before my account was turned over to Santander. Now, because my account is with Santander I must wait 30-45 business day since my account was paid off before a refund check can be issues. As of today, it is 37 business days. Is there any laws to inforce my refund sooner? Do I have any rights as a consumer that CitiFinancial sold my personal information to Santander without consent?
