Legal Question in Consumer Law in Massachusetts

Used Auto- problems, compromising my family's safety

I bought a used minivan approx.92,800mls @$6000 cash(certified bank check)2 1/2 mos ago-used car dealership.I only put 1,239 mls on vehicle. I'm having overheating problems-head gasket leakage heavy smoking under hood- took it back, owner says out of warrantee-after talking and getting a written agreement HE would pay to fix at Dealer's cost, his mechanic only patched up problem wants me to pay for thorough job- an addtl $1300 out of my pocket. Is owner/dealer obligated to pay for the repairs even though the car is ''out of warrantee'' and he drew up a contract to fix at dealer cost ?

Your rights depend on your written agreement with the dealer. YOu may call the State Attorney General's consumer protection office, the state Office of Comsumer Affairs to see if this dealer is on their bad guy list. If so, they may helop-. If not, you could call the local TV consumer reporters to see if they are interested.

legally, if you can show that the dealer engaged in unfair and deceptive practices, you can send him a demand letter u der Chapter 93A of the Massachusetts General Laws and specifically otuline the problem and your demand for satisfaction, including money damages. If problem is ot resolved then hyou may sue.
