Legal Question in Consumer Law in Massachusetts

Automobile Lemon Law

I had a motorcycle that had an engine failure. The first time the manufacturer replaced the engine in about 10 days free of charge, and paid for my towing. Almost exactly the same amount of time is failed again. The manufacturer offered me a brand new unit or the complete cost of my present unit including tax, title and fees. I had contacted a lemon law company, before hearing of the manufacturers offer. When I tried to tell the lemon law lawyer that they were going to settle for the entire amount, he told me I had started with them, and had to continue. It has been 5 months now, and I have been paying monthly payments without the use of the bike, can I accept the manufacturers offer, I don't want anything else, but the lawyer has filed a suit askign for 50,000 in punitive damages, I never asked for, nor was I told. I just want my money for the bike, can I accept the manufacturers offer?

Re: Automobile Lemon Law

You should discuss this in a face to face interview with the attorney you hired to determine whether this offer from the manufacturer is in response to a demand letter that attorney sent and whether it may be considered a reasonable offer if rejected and the case is taken to trial, thereby limiting recover to the good faith offer.

You and your attorney should be working together on this and not at odds with each other.

Good Luck! And Happy Thanksgiving!
