Legal Question in Consumer Law in Massachusetts
commercial cooler
I bought a liguor store that was in distress and put in a two new beer coolers at an expense of 36,000 dollars. During the first year I had to replace 3 light ballasts out of 14, they were covered under warranty. Now within the last 6 months two more need replacing they say its not under warranty it was a twelve month warranty. I believe its a design flaw, is there a way without great expense to have them fix these problems. It is a well known national cooler door company. company.

Re: commercial cooler
Without more information its impossible to give you a focussed or definitive answer. Your question depends on missing information, such as: the date you bought the cooler unit (more than one year ago?); the specific terms of the warranty involved; the facts leading you to claim the unit is defective (what is customary and usual burn-out rate for cooler ballasts within the industry or common to other cooler makes and models), etc.
Even if not covered by the warranty, if the performance of your unit is outside the industry norm, you might be able to leverage the situation to your advantage, but only if handled properly. There are various ways to go about seeking a resolution, depending on the specifics involved. The goal would be replacement with a new and properly functioning unit, money damages, etc - again, depending on what's best for you in the circumstances.
If you decide to push this issue with the manufacturer (distributer? much better with an attorney on your side than if you try to resolve this by yourself. Feel free to contact me directly with the additional information necessary to guide you here, and then I can provide my assessment and your possible options.
