What is the mandate that insures legal fees will be paid for by a company being sued if they are found at fault? My credit card was issued a credit after I closed the account and the company refuses to write me a check for the credit. I have sent letters, and provided documentation from the store proving the company received the credit, but failed to write me a check. What law can I reference that will hold them responsible if I pursue legal action? Or do you have any ideas for how I can handle this problem. Chase is blatantly stealing my money- $230.00!!!

You can demand relief in writing pursuant to m.g.l. c. 93A, in writing. You can also file immediate suit in small claims, without such a claim, but you would not have a right to seek attorney's fees.

I suggest that you contact a young attorney who needs to spend some time "building his/her chops," as it were -- someone who has the time to take a case for little or no money, and make it work.
