Can a consumer request to view a store video surveillance tape in order to resolve a dispute with an employee?

It depends on whether you have filed a lawsuit. If you haven't, you could always ask a manager or owner of the store for the tape. They aren't obligated to provide it to you though.
If you file a lawsuit against the employee or the employer, you could subpoena the tape through the discovery process. If you chose to go down this path, you should consider hiring an attorney to make sure you request it correctly.
