Legal Question in Consumer Law in Massachusetts

Contractor Rip-Off

I hired a guy with a Mass Contractor's License to side my house after he had completed a roofing job for me. He asked for the a down payment, which I agreed to. Obviously, I am writing because he walked with it... $5000. I have been working with the AG's office in the Commonwealth to reclaim but he has signed all assets over to family members. I have some questions;

1) If he has been running the business out of his parent's home, do they have any responsibility and can i file against them or have a lien put on their assets.

2) Is there a statute of limitations on larceny?

3) How do I go about doing my own asset check on someone?

4) Can I sue him myself without a lawyer, and if so, could you recommend a resource to guide me.

Thank You.

Re: Contractor Rip-Off

1. Your question is unclear. If there is a cause of action, it may be a fradulent transfer. Larceny may be a cause of action, but more facts are needed.

2. You probably need to file within 3 years of when the cause of action accrued.

3. I do not know. You can hire a private investigator.

4. You can sue him without an attorney, and you seem to be on the right direction. At the same time, I would not advise it, given some of the complexities. A resource in this area can be found in your local county law library.
