Dance Training Contract

I signed a contract in May 2005 to pay monthly tuition for my daughter to attend cheer leading training for the 2005/2006 season. The contract states that regardless of participation full tuition is due for the duration of this contract (through 7/06). My daughter is having medical concerns and her pediatrician recommended she stop cheer leading. Do I have a legal right to cancel the contract and stop payments? There is no wording in the contract to allow for special circumstances.

Given the facts you provide, no. This assumes you had the opportunity to read the contract before you signed it and that you were not under a mental disability or under the influence of drugs or alcohol when you signed, and were not otherwise coerced into signing it.

This does not mean that the contract will pass muster under Mass. law, since it seems rather one-sided. You may have some other avenues to get out of the contract, if the school is not properly established or makes representations about accreditation or results. It may be under investigation by the Attorney General's consumer protection office. You will have to bring all materials about the school and the contract to me or another lawyer to allow me to inquire in detail and see if you have other possible recourse.

You can try a local consumer protection person that works for a TV, radio or newspaper in the area.

You can picket the school with an "Unfair" sign.
