Legal Question in Consumer Law in Massachusetts

Have we been de-frauded?

Signed with broker in MA 4/02 before moving to Costa Rica. Broker sold boat in 9/02. New owners took possession 10/4/02. Problems: 1)Boat sold for lesser than agreed upon price; only broker knew of this 2)Broker kept all proceeds until 2/03 no payments were made during this time resulting in bad credit 3)Told us note was paid in Sept, is error within bank, we're told to ignore threats all is ok meanwhile skip tracers continue threats of legal action with daughter in NH and attempt repossession of boat but can't locate it 4)Calls to broker go unanswered/unreturned 5)We've never signed, seen or rcv'd a bill of sales or sales agreement 6)Monies owed us never rcv'd 7)Broker falsified, kept or removed possessions to be sold with boat 8)Boat is still Coast Guard registered in our name (we won't sign papers until broker is dealt with) so new owners can't yet legally use it. Much is involved here - broker has done this to others also. What action do we take- ASAP? How do we clear our credit report? I'm visiting TX to handle this. Return to CR 4/25/03. Please respond ASAP. Need to do something before leaving. Thank you.
