failure to disclose auto accident
13 months ago I bought a 2006 BMW 330xi from a Ford dealership that also has a bmw dealership in their family. I purchased with the written understanding that all mfg warranties were still in effect.I was provided with carfax rept that states no accidents or issues and that warranties still in full until 4yrs or 50k miles.I recently had an issue that I had examined at a local BMW dealership. They found and fixed a problem that would have been covered under warranty if they had not also discovered that at some point the vehicle was in an accident. Portions of the rear suspension had been reconstructed to a point that their bodyshop people claim it had to have been in an accident. It was also evident to them that various parts of the car had been repainted concistent with an accident. I know have a car that is going to require an additional $5k+ in work to get corrected. I would like to request that they buy the car back from me for the amt owed plus the cost of ownership to this pt. The car is not worth nearly what I paid for it now that this info is out. I will never be able to sell or trade without disclosing this. Do I have any legal basis for making this request? Is this an appropriate request?
