Legal Question in Consumer Law in Massachusetts

False information in purchase of used car

In July of 2003, my wife and I purchased a used automobile from a car dealership. We were told that it was a 2001 model. After taking the car into a service center for some repairs today (5/18/04), we were told that it is actually a 2000 model and not a 2001. What type of recourse can we take as we specifically bought this car because of the research that we did for the 2001 model? We certainly feel cheated and would like to exchange the car for a 2001 model. Is there an agency that we could threaten to report the car dealership to if they do not comply? Is there a time issue now that it has been 10 months after the purchase?

Re: False information in purchase of used car

There must be a meeting of the minds to have a valid contract. In this instance, there did not seem to be one. There are additional facts needed to determine your best course. If all the paperwork indicated that the car was a 2000, not a 2001, you might be hard pressed to prove that you believed you were purchasing a 2001.
