Re: G. L. c. 211, � 3,

Does the superintendency powers of the SJC extend to authority over the Attorney General who is deemed to be acting inappropriately or illegally or failing to enforce state laws or agreements? If not, who does have jurisdiction over the Attorney General?

You, the consumer, has authority under G.L. c. 93A, s 9, to act as a "private Attorney General" to file suit to declare unlawful acts, conduct or inaction that intrudes upon a legally-protected interest applicable to you, including as against the Attorney General. Depending on the circumstances, you may also have the ability under the same statute to enjoin (prevent) imminent injury to you caused by the AG. You must be personally affected by the action or inaction of the AG that intrudes upon your legally-protected interest as a Massachusetts consumer.
