me vs. major computer company???????

A computer company advertised no interest for a year on select systems. The fine print explains that no interest is for qualified buyers. The computer companies return policy is twenty-one days after purchase, for a full refund. I apply for a credit line to purchase a computer system and get approved for a three thousand dollar credit limit. I order a system on October 16, 2005. Twenty three days later my first statement closes. The statement is then mailed to me about a week later. No finance charges are applied on the first statement. However, the following month there are finance charges. When I call to dispute the charges the company tells me that I did not qualify for the promotion. Their failiure to inform me in a timely matter, let alone at all, that I did not qualify for the said promotion has put me in a contract that I cannot extricate myself from. Fair? I think not. Legal? Yes or No? What kind of action can I take? If any... please help!

Would this major computer company happen to be Dell? Because they're famous for these tactics.

With that being said, you can file a complaint with the attorney general and/or under Massachusetts General Laws 93A, you can serve them with a demand letter.

CHAPTER 93A. REGULATION OF BUSINESS PRACTICES FOR CONSUMERS PROTECTION

"Chapter 93A: Section 9. Civil actions and remedies; class action; demand for relief; damages; costs; exhausting administrative remedies..."

Please look up the above Mass.Gen.Laws on how to proceed. Basically you will need to mail first-class and certified mail your demand letter and the company has 30-days to respond.

If the company doesn't respond and/or they respond, but with no relief, you will have to file a complaint in court and attach your demand letter.
