Legal Question in Consumer Law in Massachusetts

Newly purchased used car mechanical problem caused accident

I just purchased used car from a dealership less then 30 days ago & today when I went to apply the brakes in traffic the car instead revved up and continued to move forward despite that I was applying the brakes since it was heavy slow moving traffic- I hit the vehicle in front of me which caused my car to have major damge to the front end. And to add to that- I tried to turn the car off and it would not turn off - even after I had the key out of the ignition- luckily a mechanics shop was across the street and they came over and pulled a plug off so it would shut off and not continue to rev as it was doing during this whole time. The cause of this accident is not my fault and I feel the dealership may have sold me a car with pre-existing mechanical problem- I have a 60 day warranty, but since its been involved in this accident the dealer told me ''not their problem''. What recourse do I have. Also, when I purchased the car - they said I could post-date a check for $1000.00 to June 26, 2008 as I didnt have the money at the time- can I issue a stop payment on this until this matter is resolved? The contract is written as if they already received the $1000.00 from me - no mention of post-dating check in writing. HELP!

Re: Newly purchased used car mechanical problem caused accident

You are in luck, I just had a similar experience with a major car dealer in MA, which was satisfactorily resolved. The problem has benn labled "sudden acceleration incidents". I would be happy to discuss this matter, if you'd like.
