Legal Question in Consumer Law in Massachusetts

Self Renewing Contract

In Oct 1992 a contact was signed for elevator maint with a local company. This contract was for a 3 year period and had a self renewing statement as folows. '' Either party may terminate this agreement at the end of the first thre years or at the end of any subsequent three year period by giving the other party at least thirty days prior written notice.'' I sent a notice of cancellation last week and was informed by the company that I can not cancel now. The next window for cancel is 9/30/07. Am I bound by this contract until then?

Re: Self Renewing Contract

Is the time-line as follows: Oct. 1992 to 1995; Oct. 1995 to 1998; Oct. 1998 to 2001; Oct. 2001 to 2004; Oct 2004 to 2007.

Last week was Feb. 2006 and your contract renews in Oct. 2007. Your contract states that you "place in writing 30-days prior to the expiration of the 3-year window." It seems to me, that your next chance to cancel would be September 1, 2007; thereby giving a 30-day notice prior to Oct. 2007, which would begin a new 3-year contract; i.e. 2007 to 2010?

In any event, you signed a contract agreeing to these terms. Has the other party breached in their duties under the contract?

If you have any further information, please feel free to email me at [email protected]
