Legal Question in Consumer Law in Massachusetts
In a residential condo, and as described in the master deed, each unit owner has the exclusive right and easement to use the land directly behind the unit extending to the rear property line. Also, each unit owner shall have an easement for the exclusive use of that land subject to the rights of other unit owners to pass and repass.
The questions are:
1. What is the definition of Exclusive use
2. Does Exclusive Use give the unit owner the right do do what they want on that portion of land without Trustee input
3. Are there limits to what each unit owner can do on that portion on common land
4. Do the trustees have the right to regulate what can and can not be done on that portion of property behind each unit
5. If the Trustees do put controls on that land and place limits on the unit owner, are they changing the master deed with out having a vote by the unit owners
