Legal Question in Consumer Law in Massachusetts

service hired and not meeting needs

My interior designer has not given me what i asked and now wasy even though she understood the budget of 20,000 on furnishings I had for a living room and bedroom, it is unrealistic and presented me with a 37,000 plan. Then she said if I didn't proceed and shopped for other thigns that fit my budget, I owed her 12,000 for the plan. I am shocked that this can be the case. She has a 3,000 retainer, and I wan tto be fair but 37,000 I can not afford and made clear how much money I had to spend in our first phone conversation. Please advise. Thanks so mcuh

Re: service hired and not meeting needs

Several initial questions should be addressed:

1) Is there a signed agreement between you?

2) Is there written evidence of the retainer.

3) Have all your respective communications been "memorialized" in writing? (They should be!)

Based on these and other relevant answers to additional questions, you may be entitled to several legal remedies.

You should contact a lawyer for a "free" (further) consultation asap.

Given this amount, I hope that there is a written contract?
