service issue

a marine service company worked on my boat, winterize and launch in the summer, however after they put in the water i discovered that the engine was not turning over, maybe siezed.. it was working when they picked it up in Dec '06. they claim no responsibility and my boat is in the water and wont run.. they arent offering any flexibility in re-building or at least trying to figure out what happened. im pursuing another company to fix/replace the engine. how should i proceed against the marina service co?

This will really be fact specific, i.e. how old was the motor in the first place, and how many more seasons do you think it had left?

I would also like to know what the contract says, i.e. whether they are responsible for maintaining and delivering the engine in good working order come Spring.

I would take it to someone else for a look and see what their assessment is. If they think there is some negligence or foul play on the part of the marine service company, perhaps then you should pursue it.
