Legal Question in Consumer Law in Massachusetts
Small Claims appeal
I recently filed a complaint against a Consumer Reporting Agency for multiple violations of the FCRA. I went to Small Claims court and presented my case. All my evidence was documented and it should of been an open and shut case in my favor. The Magistrate didnt feel that way and the defendant won. I know I cannot appeal, can I use the same violations with the evidence in a higher court? Or is that the final decision relating to those particular violations?
Thanks

Re: Small Claims appeal
Your appeal is to the Appeals Court and appellate court for MA. It is an expensive process because it requires a memorandum of law. You may want to contact one of the consumer protection legal offices which are funded by tax dollars. Ask the state consumer affairs office for identification of law firm or contact legal aid and they may have referral. You can also check the local bar association or the Mass. Bar Association for pro-bono or reduced fee represention
Re: Small Claims appeal
Sorry, I answered based on MA law. You brought a Fed Action. You have a certain period to appeal and the clerk's office sould tell you. You should contact the Federal Trade Commission office for advice on how to proceed.
