Title V fraud. Do I have a case?

We purchased a property in Oct 2000. In June of 2003 we needed to put in a new septic system because it would not pass inspection. There was a passing title V inspection done for this property on Nov 22, 1999, prior to us purchasing the property. The previous home owner had the system pumped within 2 weeks of the inspection and lied to the title V inspector. We have the Title V document that explicitly states the system was not pumped within 2 weeks of the inspection and according to Massachussetts state law the system cannot be pumped within 2 weeks of inspection. Do we have a case?

Although your facts and questions are not clear, it depends on what the purchase and sale agreement says. The seller is responsible for Title V compliance. If out of compliance, seller pays. If agreement provides that Seller responsible, consult with a lawyer. Not a consumer problem unless seller is in business of bying or selling property
