Vehicle in my name used by someone else

I let my best friend put a new vehicle in my name and it is being financed by Toyota Motor Credit. It came to my attention that she has defaulted on the loan 7 times in the last 3 years and I have told her in February that she must pay this off and get it out of my name. I sent her a certified letter giving her until 6/20/07 to pay it off. If she does not come thru, can I legally take that vehicle away from her? Do I have to do anything else at this point since I sent her the certified letter? The loan, registration, title and insurance policy are all in my name but she has been making the payments. thank you.

You have title to the car. If need be, you can obtain the car. You should obtain the assistance of police if necessary -- if she is not properly paying for the car, and thus is not using it with your permission, they can classify it as "stolen."

Her right would be to sue you in equity to claim the right to use the vehicle. A judge seeing the defaults and credit problems they have caused would not be sympathetic.
