Legal Question in Credit and Debt Law in Massachusetts

Auto Loan Cosigner

4 years ago I cosigned a car loan with my boyfriend for $5400. He bought a car and defaulted on the loan, I broke up with him so to punish me he blew the engine on the car and let it get reposessed. I now have a 2.5 year old daughter with him and I have a restraining order on himand have had one for over 3 years. The bank is coming after me for the money and I can't afford to pay for the car. I heard that I can take him to district court and have them declare me not responsible for the loan. It is now $6300 with legal fees. We were never married. Please advise.

Re: Auto Loan Cosigner

What you heard was basically correct. Well, the court can determine that he is responsible for the entire amount. They won't have as easy a time removing your exposure to the insurance company but the insurance company would have a difficult time collecting from you.

Good luck.
