Business Debt

I run a company whose investments have not paid off. In running the company, we came owe a company money and do not immediately have the funds to pay them. Actually they are also responsible for the situation we have gotten into. Now a vice president of that company has threatened me with a charge for mail fraud if we do not pay. Is this justified when I have not done anything wrong?
