Car Repo in Mass

Can a car be repossessed from your driveway if you own or rent the property. I rent, i'm in Mass.

A secured lender can repossess collateral property if there is no breach of peace. Through Chapter 13 Bankruptcy you can force them to give you back the car, as long as it's done before the sale date. Feel free to contact me with additional questions.

Motor vehicle repossessions are governed by Massachusetts General Laws, Chapter 255B, Section 20A ( Massachusetts Motor Vehicle Installment Sales Act). It is axiomatic that the creditor, or any agent acting on his/her behalf , may not effectuate a breach of the peace in repossessing the vehicle. Further, the repossessor is bound by the regulations set forth in the Fair Debt Collection Practices Act.
