Civil Court Judgement
My car was taken by a constable for a judgement against me for a credit card debt. I will be filing for bankruptcy soon. I need to know if there is a way to keep my car. I was not contacted or served any papers from the creditor or the courts, except what they said they sent in the mail, which I did not receive. It is documented that paperwork was sent by mail on the copy I received. I recieved copies of the judgement the night the constable showed up.I cannot afford to pay the constable fees or storage fees for this. This was the second time within two weeks this was done, by 2 separate constables for 2 different credit card co. I need to know leagally where I stand on this.

So long as the car has not been sold, you probably can get it back. Do not delay in filing your bankruptcy case, however, as once the car is sold, you may be out of luck. If you need help with your bankruptcy case, call me at 617-367-4260. David Baker
