I assume that you are in MA but they are elsewhere?

Or is it vice versa? To have any effect, you will

need to sue where they live or work, and it's especially

good if that's where they own property or have bank accounts.

It's probably cheaper to find an attorney who handles small

claims actions routinely than to travel there, if it's a plane

flight away. There are firms working at each courthouse that "cover"

like that, meaning they go to court for others quite cheaply,

and they do them all in batches.

If it's a nearby state, considering traveling there yourself

for a court appearance (and then while you're there, find an attorney

that day to make any future appearances you'll need for you.)

Moreover, how did they fail to pay you? If they bounced a check,

there are other laws to consider. If the credit card stiffed the charge,

they have a procedure to use. Please don't tell me you shipped with

an invoice to a stranger!!??? Was it to a restaurant?
