Legal Question in Credit and Debt Law in Massachusetts
Contractor
We hired a contractor to put an addition on our house. The payment was 1/3 to start, 1/3 half way thru the project and rest at completion When it was done he said he would contact us to go over anything and the final payment would be due. It has been over a year and we havent heard from him yet. How long can he wait before he comes back to collect? He knows we were unhappy about some the work and I believe he doesnt want to redo some of it. My concern is how long can he wait as we do owe him the money and can he then claim the warrenty has expird?

Re: Contractor
There is a six year statute of limitations for cotract actions. But neither of you should wait that long to communicate with each other about finalizing the contract lest the court rule you are barred by a legal theory called laches. If in doubt retain an attorney. Good Luck!
