Legal Question in Credit and Debt Law in Massachusetts
What is the correct way for a collection agency to serve papers to an individual
I have an account that was with MBNA that went delinquent and I have been unable to keep up with payments. It went to arbitration and has a current balance reported to credit agencies as $9611. However the collection agency is telling me that they will only accept 80% of a total of $14,000. I was not personally served the papers, neither was anyone in my household. They simply dropped an envelope on my front steps that only had the name Colon--name removed--on it. My legal name is--name removed---name removed-- No receipt was signed and no postage and no tracking. How should I consider this letter that had information on a past arbitration award and a proposed schedule for the proceedure toward a possible court date in 2005. What should I do. I have only just recently secured a permanant job so I have a small budget but I do wish to start cleaning up this mess.

Request to see the original evidence of amount due sent to the collection agency/attorney and an itemization of all additional amounts added to it. If not forthcoming, consult an attorney.
