Co-Signer Rights

My husband are separated and are co-owners of a Volkswagon Jetta in which I also am the co-signer. My husband has lost his job and has no source of income. The car payments are behind two months and car in in jeopardy of being repossessed. My questions are: 1. Can I take the car from his possession and use it? 2. If I pay car loan off can I get title in my name without his name?

Possession and use by you of the car would be effectuated by a written agreement and/or temporary order from a Probate Court under a Divorce or Separate Support Complaint.

Changing title into your name alone would require paying off the current auto loan.
