Legal Question in Credit and Debt Law in Massachusetts

co-signer-car repo

In 1996 my husband co-signed for a car loan, the car was repossessed, after the auction my son owed $2800.he never paid it.we are now trying to re-finance our home but the collection agency wants $8300. and says there is a lein on my property.the mortgage broker contacted them with an offer to pay $3000. They refused and told the mortgage broker they are taking ''legal'' action against us now.We haven't heard about this bill for years. The bills are coming in my husbands name, not our son,who lives at the same address. Any suggestions on what our options are? We would still like to re-finance, but $8300. is out of the question.

Re: co-signer-car repo

there are various issues that arise from the repossession, lien and obligation. For 8,300 I would suggest you ask them for all information related to the loan, repossession, court action related to the lien, and the manner by which the obligation was determined.
