Legal Question in Credit and Debt Law in Massachusetts

Credit Cards

I own a home and have exceeded my credit limit on credit cards. I have a Homestead Act. One of my credit cards is the same company as a home equity loan. Will my default of payment on the credit cards be protected under the Homestead Act? My mortgage and Equity line is current.

Re: Credit Cards

That's going to depends on things you do not mention, such as (1) the value of your home; (2) when you purchased it; and (3) what you mean by protected. If you default on your credit cards, you can still be sued, and a judgment can still be obtained.

If you're having problems paying your debt, I urge you to seek out your options by talking directly to professionals. Please feel free to send me an email to tell me more about your situation.
