Legal Question in Credit and Debt Law in Massachusetts

Hello,

I own a debt that is currently in a collection agency. The debt is in my name only and not my wife's. If I'm taken to court for this matter can they garnish my wife's wages?

thank you

In my experience, debt collection firms are quick to take unpaid debts to suit in the present economy. Assuming your wife was not an account or cardholder, they cannot garnish your wife's wages. Feel free to give me a call if you would like legal counsel. I represent debtors who are being threatened with suit, or who have been sued. Call my office if you want to talk strategy. 617-357-4898.

No, they cannot garnish a non-account-holder's wages. If you wish to see if you can discharge (erase) this and other debts through a bankruptcy filing, contact my office.
