Legal Question in Credit and Debt Law in Massachusetts

Debt Collection harrassment

I am currently in deep debt. At the present time I am disabled and unable to keep up with payments. My utilities are ready to be shut off.

I have a problem with one individual creditor that calls every four days, although I have told them I'm unable to make a payment, only receive one source of income and only one check a month from that source.

I have told them that calling every four days is harrassment. Seeing as I have told them nothing is changing as far as income is concerned, they say no it is not and they will continue to call every four days.

Is this legal? This is a very large Department Store chain that I am dealing with.

Thank you in advance,

Ann

Re: Debt Collection harrassment

Debt collectors are heavily regulated as to what they can and cannot do. Unfortunately, the legal definition of a "debt collector" does not include the person you owe the money to, but rather to a third party. So, if it is the department store itself that is calling you, the "debt collection" law doesn't really apply. Regardless, it sound like you need a bankruptcy case. I can help you with that.
