Legal Question in Credit and Debt Law in Massachusetts

Debt Collector & Court

I have a notice of case mgt rcvd for a past debt (credit card) from 6 yrs ago. The debt collector has sent me interrogatories to answer as well as prodcution of docs rqst. What are my rights (if any) and what is the workflow with this? I thought the statute of limitations ran out (6 yrs-MA) so that they could not do this. Just looking for some advice seeing as I am personally appearing without an attorney. thank you!

Re: Debt Collector & Court

Making a payment can reset the clock on the statute of limitiations. If you think the statute of limitations has run, you need to please and prove that to the court to have the case dismissed. You should definitely show up at the case management conference and you need to respond to the interrogatories and document requests. Failure to respond to interrogatories can result in judgment being etered against you. Have you contacted the other side and tried to work out a resolution to the case?
