Re: dept collection

Collection law provides for attachments prior to obtaining judgement in certain instances. You should have recorded a homestead on your primary residence. This prevents a forced sale of your home if a lien or judgement is obtained against you.

You may also have your debt collection defended by an attorney. There are specific legal requirements for creditors seeking to collect a consumer debt. Violations of the Fair Debt Collections Procedures Act and Massachusetts General Law Chapter 93A may provide you specific legal rights also.

Re: dept collection

A litigant, including a debt-collection plaintiff, has a number of tools to aid in collection, including pre-suit attachment, and wage garnishment, seizure, and other remedies post-suit.

Attorney Wood is correct that you have legal options, even if you owe the debt, and you should speak with an attorney to determine what can be done to assist you.
