Legal Question in Credit and Debt Law in Massachusetts

Dr. Claymans Bill

I am paying a physician $5.00 monthly on a $400.00 bill and have just recently received a bill threatening to submit the account to a collections agency if I do not pay $10.00 weekly. Is this legal? Can this doctor decide how much I should pay and when?

Did you have an agreement for the $5? Neither party can decide what to pay, it has to be an agreement. If you arbitrarily decided to pay $5, the doctor can decide to demand $10. Actually, the doctor can demand full payment if there was no agreement before he provided the services, and can take you to court.
