Legal Question in Credit and Debt Law in Massachusetts

Ex-Boyfriend trying to sue me

Ex-boyfriend is suing me in small claims court. He says he loaned me money in our relationship, which he did not. He did give me some money, but not nearly as much as he is suing me for. (2500 bucks.) HE left me. I came home from work one day and he was gone, and he told the landlord i was moving out too, so I had to move out. I had to pay the final two months utilities and he wouldn't split them with me at all, even though I asked more than once. Now he's suing me for any money he's ever spent on me in the relationship.

Re: Ex-Boyfriend trying to sue me

First, your ex can only sue you for $2,000 in Small Claims court since this is the limit. I am not sure from your question whether he has filed or has only threatened to file. If he has filed, you are entitled to file an answer disputing his claim and you can file any claims you have against him for 1/2 of the utility bills. The hearing in Small Claims will be in front of a clerk magistrate. Your ex will need to provide evidence that he made loans to you and you failed to re-pay. Absent any written proof of the loans, it will be his word against yours. You will simply need to testify that he did not provide any loans nor did you sign anything stating you would pay him back any money he did spend on you during the relationship. Your best strategy would be to file an answer with claims for utility bills and show up at the hearing to contest his claim.
