Legal Question in Credit and Debt Law in Massachusetts

Exemployer caused bad credit report

An exemployer took me to small claimes court and won. I paid the amount . My bank informed me of an outstanding judgment against me from that employer. My credit rating is no longer good. The court was never sent notice that the judgment was satisfied.

It can take two days off from work to settle, and was wondering if I can recoup lost wages at small claims court due to exemployer refusing to notify the court that the judgement was fullfilled.

Re: Exemployer caused bad credit report

It seems kind of crazy to take more time off from work for another small claims case. You say the ex-employer refused to notify the court of the satisfied judgment, but the first part implies only that the employer just did not notify the court. Small claims is informal, and usually neither side has a lawyer. If that was true in this case, I doubt you would get too far with any claim. Chances are the ex-employer did not realize he was supposed to notify the court. On the other hand, if you had had a lawyer, s/he would have made sure the satisfaction was received by the court. You have also found that you could and did so. If the employer had a lawyer, you might file a claim against him/her, or a complaint with the Board of Bar Overseers.

You can require the 3 major credit reporting bureaus to check and correct their information, and to allow you to have a written explanation included in your credit report. You are now allowed one free copy of each bureau's credit report on you for free by both state and federal law.
