Legal Question in Credit and Debt Law in Massachusetts

Faliure to Appear

I just found out that I have to appear tomorrow morning in court over a civil matter. Apparently, this is the second time the courts have sent notification, even though I never recieved the first one. The letter says that if I do not show up that a warrant will be issued for my arrest. I fully plan on going to court tomorrow, but what should I be prepared for? Will I have to simply set a new court date or am I going to be arrested when I show up? Thanks for the help.

Re: Faliure to Appear

It is difficult to say for sure, but that is probably a notice from the sheriff that a "capias" has been issued. A "capias" (in this context) is a warrant for your arrest based on a failure to comply with a court order to pay a creditor. Usually the sheriff gives you a chance to show up without being actually arrested, so if you show up, I would be surprised if you were actually arrested. You will probably have to tell the judge why you didn't pay the creditor. David Baker
