Legal Question in Credit and Debt Law in Massachusetts

Family Member Opened Credit Card Using My Info

I have a situtation where either my information was crossed with a family member or they opened a credit card using my information when I was under the age of 18. The card is not in my name but is linked to my SS# and therefore shows up on my credit report. The account reflects adverse information that is hurting my otherwise perfect credit, and I would like to have the info removed. If someone in my family opened an account using my information is it possible to have the information removed and reflected under the correct SS# without any legal ramifications to that person?

Thank You

Re: Family Member Opened Credit Card Using My Info

You should contact the credit reporting agency and inform them the credit card does not belong to you and that you dispute the item. The credit reporting agency must then research and verify the accuracy of the information. If the agency insists the item is valid, you have the option to add a note in your credit file to dispute the validity of the debt. The agency must also provide the contact information of the creditor who verified the information. You could also contact the creditor and demand proof that the account is yours (copy of signed credit applicaiton).
