Legal Question in Credit and Debt Law in Massachusetts

My ex and father of my son is doing a 10yr sentence(5 done).I am living in the his house paying mortgage and bills so he has a place to go when he gets out and we have a roof over our heads.But with tough economy his credit cards have been my least concern compared to the morgage.Calls are coming in and don't want to tell them,afraid the mortgage Co. will catch wind.That only means balances are getting higher.Any solutions?

I'm sorry to hear about your present situation.

If you are not a credit card-holder with your ex, and your name is not on the credit card account with your ex, and you have not used the accounts to make purchases for you and your family, then you likely have no obligation to repay these debts.

If he does not pay his bills, they will be sent to collections. If he still does not pay, they will likely file suit. If you can afford it, you may want to speak with an attorney.

You are in a tough situation, and I am sorry to hear it. I think you need to talk to a bankruptcy lawyer. We know how to get rid of the bills, while allowing you to keep your house and possessions in almost all cases. You are doing the right ting by ignoring the bills and paying the mortgage.
