Can a handwritten contract be enforceable in Masschusettes?

I lent some money to one of my friend. He signed a basic handwritten contract stating that he borrowed x amount of money from me.

Does this type of handwritten document enforceable when he defaults to pay me the money back? It was such a bad idea to lent him to begin with.

Your advice would greatly help me. Thank you.

Yes. It is enforcible as evidence of the debt. And,if sufficient particulars are included over the signature of the debtor, may be considered a promissory note. Retain an attorney to review it and file suit as appropriate. Good Luck!

Assuming certain basic elements are present, the handwritten contract might very well be a contract. At the very least, it is evidence of the debt.

You should speak with an attorney, who can help you decide which court to file in and instruct you on whether you might obtain any sort of prejudgment security.

There is no prohibition in the Commonwealth of Massachusetts against handwritten contracts.;)
