Legal Question in Credit and Debt Law in Massachusetts

My husband and I have been seperated, though not legally, since November 2010. He lives in a different city in MA than I. I recently found out he took out a car loan. My concern is he may default given past credit history. If he does, am I bound in anyway to repay this loan? The loan is in his name only.

I plan on filing for divorce once tax time arrive in 2011 and I receive my refund.

Unless there is a court judgment limiting a spouse's obligation for support/alimony for the other spouse, one spouse may be held liable for the debts of the other to the extent the debt can be shown to have been incurred for "necessaries of livelihood".

The sooner you retain an attorney to file for divorce the better. Good Luck!
