Re: what is a judgement against you?

It means that a court has determined that you are legally responsible for a debt.

A judgment can be obtained either through a trial, or by default if you fail to appear or respond.

Re: what is a judgement against you?

In simple terms, a judgment is a declaration (or decision) by a court of competent jurisdiction (power) to decide your case (dispute). If and when the court renders a judgment against the person or party sued, the court provides remedies, in the form of various procedures and machinations, to enforce the judgment of the court. These remedies can take the form of liens (garnishments and attachments) and levies effectuated against non exempt property you possess or any goods , effects or credits owed to you by third parties. You do have the right to appeal the judgment rendered against you, subject to limited exceptions (small claims court). The judgment creditor ( the person who obtained the judgment) also has the option of summoning you before the court to examine you as to the nature and extent of your assets to pay the judgment. The area of collections and post judgment enforcement is a complex area of the law and requires the services of a licensed attorney who concentrates in the area. Please feel free to contact my office for a free consult based on the specific facts of your situation.
