Legal Question in Credit and Debt Law in Massachusetts

Judgement Against Me!

Hi!

I got a notice in the mail that I failed to pay a judgment against me with a credit card company and that I have to appear in court regarding this failure to pay. I never received the notice telling me that I have to pay this amount and when it was due. Unfortuantely, I can not come up with that money by the time I have to appear in court. What will legally be done to me? Will I lose my car and have my wages garnished?

Thanks!

Re: Judgement Against Me!

The notice should tell you which court issued the judgment; go to the clerk's office and ask to see the file; the file should show the critical documents, including any evidence of service. This also provides you with an opportunity to file a motion to vacate the judgment and either restore the matter to the trial list, or move to dismiss for lack of proper notice.
