Legal Question in Credit and Debt Law in Massachusetts

Judgements and liens

I am on the title of a mortgage with my Uncle. He is not connected to any of my credit card debt. I have a Judgment for $30,000 which they are syaing they will attempt to put a lien on my house. Can they do this if I am not the sole owner? I live in MA.

The short answer is "yes". You might consider the benefits of a filed homestead. See your county registry of deeds web site. Time is always of the essence.

Re: Judgements and liens

Yes, but a Homestead Declaration will not help you here because the debt has already been incurred.

Depending upon how the plaintiff obtained judgment against you, you may want to try to go back into court and attempt to remove the judgment.

Your other option is to either negotiate a payment plan with the judgment holder or attempt to negotiate a large lump-sum settlement.

Feel free to contact my office if you would like to discuss your options in greater detail.
