Legal Question in Credit and Debt Law in Massachusetts

Late Condominium Dues

I was served with a summons for Trial Court Civil Action in a case that I was late in paying my condominium dues. I sent them a check for the overdue fees via certified mail. They have not picked up the certified letter at the post office with the check that I sent over a week ago. I am worried that they will take me to court. How should I proceed now?

Re: Late Condominium Dues

Your best course of action is to contact the plaintiff ( the person or entity bringing forth the action) via telephone and ask the amount needed to settle out the lawsuit. If you agree with this amount, explain that you sent a check for that amount over a week ago via certified mail and request they pick it up. You could also offer to hand deliver another check. (make sure to cancel your prior check!). In either case, make sure you have them file a withdrawal of their action as well as tender to you a mutual release. Please feel free to contact my office if you need any assistance.
